A governmental entity sued the surety on a performance bond for work performed years earlier by others on a project. Leveraging the Texas Government Code to support a summary judgment motion premised upon the running of the statute of limitations on the governmental entity’s claim against the surety, the surety was dismissed from the lawsuit before the hearing on the motion took place.
