Stibbs & Co. attorneys successfully invalidated and removed a lien filed by a sub-sub-contractor against a construction project where Stibbs & Co. client, was the general contractor. The Court agreed with Stibbs and Co.’s argument – set forth in its summary motion to remove an invalid or unenforceable lien pursuant to the Texas Property Code – that the lien had been untimely noticed and was therefore, unenforceable. Included in the Court’s ruling was an award to the Stibbs & Co. client general contractor of all reasonable and necessary attorney’s fees expended to pursue removal of the lien.
