Stibbs & Co. attorneys obtained a default judgment in favor of its client in an Opposition proceeding in the Trademark Trial and Appeal Board (TTAB) of the United States Patent & Trademark Office.. The TTAB entered the default judgment after the trademark applicant failed to respond to an Opposition brief prepared by Jeffrey Wendt with assistance from Michael Ellis and Sarah Micle. The brief asserted that there would be a great likelihood of confusion in the relevant market for the goods being sold by our client should applicant’s federal trademark application proceed to register. The brief also alleged fraud in the attempted registration of applicant’s mark, based on public documents filed by the applicant.
